OrganizedFlex: Explanation of works in NL


You are a foreign (EU citizen) ZZP'er (independent entrepreneur without staff) who wants to perform a temporary service or assignment in the Netherlands. ZZP'ers can perform services in another EU member state.


However, self-employed persons who are not nationals of the European Economic Area (EEA) or Switzerland (hereafter: third-country nationals) cannot be simply employed in the Netherlands. In principle, they need a permit to work and reside in the Netherlands.


When third-country nationals registered as ZZP (self-employed person without staff) in another EU country and established there we talk of an exception.


Conditions set:

  1. The third-country national has his ZZP company registered and established in a member state of the European Economic Area (EEA) or Switzerland;
  2. The third-country national comes to the Netherlands to provide services on behalf of his company;
  3. The third-country national has a valid right of residence in the Member State of residence as a self-employed person for more than 3 months;
  4. The admission to work in the Member State of residence are valid at least for the duration of the work to be performed in the Netherlands;
  5. The third-country national holds a passport and a residence permit as a self-employed person with a period of validity at least equal to the duration of the work to be performed in the Netherlands. This ensures return to the country of origin or residence.
If these conditions are met, these persons, together with EU citizens, may move freely across European borders to come and work in the Netherlands. 

Obligations
In the case of employment in the Netherlands, you must comply with a number of administrative obligations as a ZZP'er, including the reporting obligation that must be done at least 2 days prior to employment in the online portal (Posted Workers Portal). The service recipient (client) must check the data as well as approve it in the online portal. Failure to comply with this obligation can be fined by the Dutch labour inspectorate.

Self-employed workers
The obligation to have certain documents available at the workplace:
  • identification;
  • residence permit as a self-employed person (third-country nationals);
  • Model agreement for the project;
  • A1 forms;
  • Invoices;

Note: Are you a Ukrainian refugee working as a self-employed person? If so, the service recipient (client) must apply for a work permit (TWV) in each situation.
