In the Netherlands, the mandatory certification and authorisation requirement for the flex industry has been postponed for the 2nd time. These new regulations, laid down in the Wet toelating terbeschikkingstelling van arbeidskrachten (WTTA), have major implications for temporary employment agencies and secondment agencies. From the date of entry into force, certification within the flex industry is essential to be allowed to hire out workers. With the expected introduction of the WTTA and subsequent enforcement, strict requirements will be imposed on the certification of companies in the flex industry. Under the Workforce Allocation by Intermediaries Act (WAADI), an admission system will be introduced that requires companies to be certified. This certification is necessary to maintain compliance with legal requirements in addition to the WagwEU directives (Directive 2014/67/EU).

Companies wishing to continue secondment labor must meet the following requirements:

  1. Certification according to the SNA 4400-2 standard: This certificate is a requirement to benefit from transitional arrangements and to continue operating in the sector.
  2. WTTA inspection report: A valid inspection report is required for admission under the WTTA.
  3. VOG for each legal entity: A Certificate of Good Conduct (VOG) is required for application for certification.
  4. Security deposit of 100,000 euros: New lenders must pay a deposit unless they have been demonstrably bona fide for four years.

The introduction of the new admission system for the flex industry and secondment agencies in the Netherlands marks an important step in the regulation of these sectors. Who exactly does Mandatory Certification within the Flex Industry apply to, and what options are available?

Any company or legal entity that lends labor (such as temporary workers, secondees, payroll workers) to or within the Netherlands, under the management and supervision of a third party, is required to obtain an authorisation. This applies regardless of whether the lender is based in the Netherlands or abroad, and regardless of whether the workers are Dutch nationals or labour migrants.

What do YOU have to do to obtain the Mandatory Certification for Lenders?

In the current situation, every hirer must already comply with employment conditions according to the Law on allocation of labour forces by intermediaries (WAADI). These apply in addition to the employment conditions from the WML, Working Conditions Act, Working Hours Act and the Avv. Voluntarily obtaining the SNA 4400-2 certificate confirms that your organisation complies with the employment conditions laid down in the WAADI. 

In the new system, the following conditions have been added:
  • To apply for admission, a valid Wtta inspection report must be able to be shown. If you are SNA 4400-2 certified as an organisation, you can make use of the transitional right;
  • A Certificate of Good Conduct (VOG) is required for every legal entity of the company;
  • New hirers must pay a 100,000 euro deposit. You get this deposit back after four years. Companies that have been demonstrably bona fide in business for four years are exempted from the deposit, provided they can submit the appropriate documents from the Chamber of Commerce and clean records from the Tax Office;
  • The accommodation offered must be SNF certified, this also applies to private residences.
  • You may only post - send out employees when you are authorised by the Minister of Social Affairs and Employment;
