OrganizedFlex: WAADI admissions system audit


Introduction

Conformity assessment and accreditation are tools that have emerged in the private sector with the aim of providing transparency about the quality of products and services. With conformity assessment, aspects of a product or service that are not directly insightful can be made transparent. This transparency helps facilitate (international) transactions between companies and between companies and consumers. And thus to the better functioning of markets and international trade.


Assessment program
Organizedflex has developed an assessment programme to quickly assess service providers, service recipients and self-employed persons on the implementation of the WagwEU Directives (Directive 2014/67/EU) in their organisation. This assessment is summarised in a detailed report indicating which parts of Directive 2014/67/EU have been correctly and not yet correctly implemented.  For the parts that have not yet been implemented correctly, a recommendation is made in the report.



Law on the admission of posting of workers

This bill introduces an authorisation system for employment agencies and other companies that provide labour. Under the new system, hirers will only be allowed to operate in the market if they are authorised to do so. For this, they must, among other things, provide a Certificate of Good Conduct (VOG), transfer a deposit of 100,000 euros, prove that they pay the right wages and pay their taxes. Periodic checks are carried out to ensure that employment agencies remain compliant. Companies that use employment agencies, known as hirers, are only allowed to do business with employment agencies that are admitted to the market. The Labour Inspectorate will monitor the obligations for user and user agencies. The bill also contains transitional law to encourage - in the run-up to the entry into force of the obligation of admission on 1 January 2027 - hirers to register before 1 July 2026 and, in the run-up to that, to be voluntarily certified by the Stichting Normering Arbeid (SNA).
