OrganizedFlex: Hiring foreign employees


Are you a service recipient (client) in the Netherlands using a foreign company (service provider) or a foreign self-employed person from the EEA or Switzerland for a temporary job or project? If so, you have obligations.


Obligations
In case of employment of EU employees (EU Citizens) in the Netherlands, you as service recipient (client) must check the service provider's employee registration and also approve it in the online portal. (Posted Workers Portal) Failure to comply with this obligation may be fined by the Dutch labour inspectorate.


However, workers who are not nationals of the European Economic Area (EEA) or Switzerland (hereinafter: third-country nationals) cannot be employed in the Netherlands just like that. In principle, they need a permit to work and reside in the Netherlands.


In some cases, however, the (often) complex procedure to obtain such authorisation does not have to be followed. This is the case, for example, for third-country nationals employed by a company based in the European Union who are temporarily seconded to the Netherlands for a specific project as part of their employment. This secondment is sometimes popularly referred to as the "Vander Elst exemption". However, it is subject to strict conditions.


In addition, employees are entitled to the main terms and conditions of employment applicable in the EU country to which they are posted. This is regulated by the Act on Working Conditions of Posted Workers in the European Union (WagwEU) and the Act on Declaring Provisions of Collective Bargaining Agreements Universally Binding and Non-Binding the Act (Avv).
